I don’t understand what your dvd drive has to do with your xbox overheating? Tampering with the dvd drive will void your warranty and if you decide to go on XBL with a tampered dvd drive (ie: mod’d, flash’d etc) then yes you will be banned from XBL. They will have your ip and never allow you to go on XBL again; however, you can just change your ip address by getting a new network card that assigns a diff one…too much trouble in my opinion.

No. The drive has nothing to do with overheating anyway. The problem is that the 360 does not recognize regular replacement drives. If you planned on replacing it, you need a drive from another 360. Otherwise you would have to flash it to trick it into recognizing the drive which will get you banned.
